2008 Tax Law Changes: What You Should Know Before You File

A Tax Fact from The Tax Institute at H&R Block

Dozens of tax relief provisions that expired at the end of 2007 – and more set to expire on Dec. 31, 2008 – have been granted an “extension” by members of Congress as part of the $700 billion rescue legislation passed on Oct. 3, 2008. Others are tax changes for Tax Year 2008 and/or 2009.

And this is very good news for taxpayers. Many Americans, for example, would have been negatively impacted had these popular tax breaks not been extended. The IRS reported that without the extender passage, 19.2 million individuals would have been negatively affected by expiration of just three of the deductions in the package: state and local taxes, college tuition and fees, and teachers’ purchase of school supplies.

Let’s take a quick look at some of the tax provisions that are new or were modified and that apply for 2008 and in some cases, through 2009 or 2010:

AMT or Alternative Minimum Tax.  The exemption amounts increased to $46,200 (or $69,950 married filing jointly) up from 2007 amounts of $44,350 (or $66,250 married filing jointly) Extended through 2008

Child tax credit. For 2008 only, eligibility for the refundable child tax credit is expanded to include individuals who earn at least $8,500. Prior to the law change, only individuals who earned at least $12,050 were eligible to claim a refundable child tax credit. The maximum benefit from the change is about $530.

Long-term capital gains. Long-term capital gains are taxed at 0% to the extent the taxpayer’s taxable income is in the 10% or 15% tax brackets. The 0% rate applies for tax years 2008 through 2010. But parents beware the kiddie tax, which may require that your child pay tax on her unearned income over $1,900 as if you received it.

Refundable first-time homebuyer credit. Taxpayers who purchased a principal residence from April 9, 2008 through June 30, 2009 and who have not owned a principal residence in the last 3 years may claim a refundable credit equal to 10% of the purchase price of the home. The maximum credit is $7,500 ($3,750 married filing separately). Eligibility for the credit phases out for taxpayers with a Modified Adjusted Gross income between $75,000 and $95,000 ($150,000 and $170,000 married filing jointly). The credit is repaid in 15 equal installments starting two years after the year the credit is claimed. For example, if the credit is claimed on the 2008 return, repayment of the credit begins on the 2010 return; repayment is accelerated if the home is sold or no longer used as a principal residence.

Real property tax. Non-itemizers may claim an additional standard deduction for state and local real property taxes paid for tax years 2008 and 2009. The maximum deduction is $500 ($1,000 married filing jointly).

Recovery rebate credit. The rebate that was paid in 2008 will be reconciled on the 2008 tax return. Taxpayers will receive any additional credit due, but need not repay any “excess” credit received.

The following tax breaks were extended not only for 2008 but also for 2009:

Sales tax deduction. The deduction for state and local sales taxes in lieu of state and local income taxes.

Tuition & fees deduction. The deduction for up to $4,000 of higher education expenses.
Teacher’s Education Expenses: The $250 educator expense deduction.

IRAs – charitable contributions. The exclusion of taxable distributions of up to $100,000 from IRA funds contributed directly to a charity.

The deduction for mortgage insurance premiums paid on a qualified mortgage was extended through 2010.

Rose&Rive- Box 12 should be on the right hand side of your 1099R, did it get cut off by chance? If so you will need to call and get a new one. Or is there just nothing in box 12? If there is nothing in box 12, you could try and enter 0. I had to take out $60,000 from my IRA to complete work around my house and to keep from going into forclosure. I am 56 so I had to pay 20% taxes and 10% pentality. Even though I took out $9,000 of the 60k for taxes, we still owed $16,8K to the IRS. Any thing I can do about this???

HRB requires state distribution for 1099R which is supposed to come from block 12 of the 1099R. There is no block 12 on my 1099. I can't move beyond that screen.

I entered my 1099-ssa exactly as it appeared on the statement I received in the mail. This software says I have an error that the amounts entered don't add up properly but, in fact, they do!. I want to efile but the message says I can't unless I fix the error which is not an error at all and that I can't fix! This is VERY frustrating, I have efiled with HRB for the past several years with no trouble.

My husband and I did not receive a stimulus payment because we are in chapter 13. We received a letter from the IRS stating that we may be able to claim a credit on our '08 federal return. Joyce: To qualify for the earned income credit, you must work and have earned income. If you are married and file a join return, you meet this rule if at least one spouse works and has earned income. If you are retired on disability, benefits you receive under your employers disability retirement plan are considered earned income until you reach minimum retirement age. Beginning on the day after you reach minimum retirement age, payments you receive are taxable as a pension and are not considered earned income. Cristy: Since both children are you daughters and both lived with you for more than 6 months in 2008, if your daughters were under age 19 (or under age 24 and a student or any age and disabled) at the end of 2008, they would be a qualifying children for purposes of the Earned Income Credit. The noncustodial parent could claim the exemption and the child tax credit for the one daughter. However, the noncustodial cannot claim the child as a qualifying child for the other tax benefits: head of household filing status, the credit for child and dependent care expenses, the exclusion for dependent care benefits, and the Earned Income Credit. My son (age 28) and his wife received a total of $300 last year for their stimulus payment. They filed married / jointly this year. For some reason, the IRS took $300 out of the amount that they were supposed to get as a refund, and they were told that it was because of getting the stimulus payment. I was of the idea that these payments did not have to be repaid. Can you explain what happened? Thanks.

My husband was forced to retire in 2001. since he collects a disably-retirement/SSD. The IRS decidied to change it to early-retirement. We were told that once we take the disably option-2 that we can change it for any reason. How can the IRS do this. Or how can I get this changed back. With it as a early-retirement we can not claim our son who is twelve. When it was a disably we could claim him on the EIC. I make $36000 per year and I'm a single parent with my two kids who live with me everyday of the year. Their father lives in another state and they haven't seen him in about 4 years; however, on the divorce decree, he gets to claim one of the girls on his taxes every year. Is there a way to file for Earned Income Credit for a child that you support and who lives with you, but you can't claim as a dependent? Also, if you work 2 jobs, is there no consideration for the second job? Or, does it just look like 1 lump sum that you earned?

thanks rwakefield1. i was waiting for over a month and a half for form 8606 to be available with hr block. i e-filed last night using the free turbo tax software online at turbotax.com and i didn't even need to file form 8606. it was fast, easy, and cheap! hr block was such a waste of time, i should have used turbo tax from the get go. if you're waiting for form 8606 - don't! go to turbo tax and get it done.

If you are waiting for this 8086 form thing I have the solution. Go file your return using the free e-file TurboTax software. It is extremely user friendly and never mentions a thing about the 8086 form. I have been trying to file with HR Block for over a month...and I just filed my return with TurboTax with no issues in a few minutes.

In 2007, I fought cancer and worked less than half a year. I was living with my mother and a brother. My brother claimed me on his 2007 tax return. Therefore, I did not claim my taxes for 2007. My brother also claimed our mother. Both, my brother and my mother, received a letter stating they would be receiving a stimulus check. My brother claims he received his of $300 Dollars. My mother does not remember, but my brother seems to think she also received one of $300 Dollars. I, on the other hand, did not receive a letter or a check. Filling out my 2008 tax return, I was unable to discern whether I was able to claim a stimulus check. There seems to be no explanation for my particular situation, or the explanations are ambiguous.

I am still confused about the new laws for foster parents this year. I'm still not sure if a child can be claimed as a dependent or not after reading the information on tax cut online. It explains that foster parents can now claim dependents even if : - You receieve support from the foster care agency -you don't provide half the childs supportout of your own pocket provided that the child doesn't pay half of the support -you have the child living with you for the entire year. However, what I am not sure about is if a government or a tax exempt child placement agency makes the payments to you as a foster parent you can't claim the child. How do we determine if the agency is tax exempt ? Would an agency such as the Hamilton County Child and Family Services exclude someone from claiming the child as a dependent ? I'm thinking no but the first paragraph makes it confusing. Looking forward to the answer and any recommendations.

H&R Block has prepared the returns for my spouse & I the last several years. It is the ONLY firm I have ever used which does not have a pre-filing "tax organizer" available for its clients. It would make things much easier for us taxpayers and your staff if you made a good tax organizer available on line. Then we could print it out, fill it in, and take it to our local H&R Block tax specialist when we go in to do out annual filing....

I never received the Stimulus check in 2008, although I filed my taxes ontime for the 2007 tax year. I filed through H&R Block & received my refund via an emerald card advance. So is that considered a direct deposit refund? So the IRS website says that if you filed and received a refund via direct deposit, you should get it the same way (the stimulus check) I should have received $1800 according to the IRS website, (married w/2kids) I chose the thing on my 2008 filing that says I didn't get it... so it added $1300 (not 1800) to my refund. It's just weird. I'm guessing because of the way I received my refund, that was the problem....

To claim the son as a dependent, all of the following tests must be met: 1)The person must be related to you or live with you all year. 2)The person's gross income must be less than $3,500 (for 2008). That means that his wages, unemployment, and all other taxable income must total less than $3,500. 3)You must have paid more than half of the person's support for the year. You meet requirement #1. If you do not also meet requirement #2, you cannot claim your son as a dependent. If you meet requirement #2, you'll need a support worksheet in IRS Publication 501, http://www.irs.gov/pub/irs-pdf/p501.pdf, beginning on page 20. I hope this helps answer your question. There isn't good guidance regarding this situation, but I can tell you that the temporary rental of a home while it is on the market to be sold, has been held to NOT covert it to rental property. Although there is no requirement that you occupy the home at the time of the debt discharge, the law does say that the home must be your principal residence. The fact that you had established another residence prior to the debt discharge may be a problem. Unfortunately, without IRS guidance, it is unclear how your situation should be treated. Does anyone know how the tax relief for this situation? Cancelation of debt works on a home you bought as a primary residence, but thanks to your mortgage company employer closes the doors 6 months later - moves you across country to keep your job, the house wouldn't sell, had to rent it out then finally sold it on short sale. I've read the tax relief will not apply to rental property, but I think I have a dang good case to present. Anyone going through this? Suggestions?

A gelman - For 2008, the medical mileage rate is 19 cents per mile from 1/1/08 to 6/30/08 and 27 cents per mile from 7/1/08 to 12/31/08. The VA mileage rate for veterans who visit VA hospitals and clinics is 11 cents through 1/31/08, 28.5 cents per mile from 2/1/08 through 11/16/08. From 11/17/08 through 12/31/08 the rate is 41.5 cents per mile. The February 2008 increase was the first increase in the VA rate in 30 years. I see from above that there are changes this year to IRA contributions and that Form 8606 has not been uploaded to your online filing system yet. However, Form 8606 has been available on IRS.gov since Jan 7. How long before your system accepts this form? Thanks.

what is the miles for dr. visit this year 2008 & also for "VA" miles. In 2007 it was I think 12cents, & "VA" miles I think it was 23cents.

timfletcher04... The IRS officially starts accepting e-filed returns beginning Friday, January 16. No e-filed returns will be processed prior to the 16th, though testing of systems with IRS vedors such as H&R Block may be taking place earlier. The best advice is to e-file on Friday, Jan. 16 when the IRS officially opens up e-file for acceptance of Tax Year 2008 returns. Denise Sposato, H&R Block

fishinged .... For Tax Year 2008, married filing jointly filers' earned income and adjusted gross income must each be less than $41,646 with two or more qualifying children. The maximum Earned Income tax credit for Tax Year 2008 is $4,824 with two or more qualifying children. Investment income must also be $2,950 or less for the year. I hope this information helps. I was wondering where the information about e-file being excepted on Jan 16th came from. I had talked to the IRS 2 days ago and was informed that e-file was excepted on Jan 13th.
